The short version
- These Terms are a contract between you and Lebx, which operates Lebx Mail. By creating an account you accept them.
- You own your content and contact lists. You give us only the rights we need to run the service for you.
- You may only email people who have given you permission. Spam gets accounts suspended — see the Acceptable Use Policy.
- Plans are billed in advance and renew automatically until you cancel. Fees are generally non-refundable — see the Refund Policy.
- The service is provided "as is", and our liability is capped at what you paid us in the previous three months.
This summary is for convenience only — the full text below is what applies.
About these Terms
Lebx Mail (the "Service") is an email marketing, automation, funnel and advertising platform operated by Lebx ("Lebx", "we", "us" or "our"), based in India. These Terms of Service ("Terms") govern your access to and use of the Service, including our websites, web application and any related services.
By creating an account, clicking to accept these Terms or using the Service, you agree to be bound by them. If you use the Service on behalf of a company or other organisation, you confirm you have authority to bind that organisation, and "you" means that organisation.
The following documents form part of these Terms: the Acceptable Use & Anti-Spam Policy, the Refund & Cancellation Policy and the Data Processing Addendum. Our Privacy Policy explains how we handle personal data.
The Service is intended for business and professional use. If you do not agree to these Terms, do not use the Service.
Eligibility and your account
- You must be at least 18 years old and able to form a binding contract under the laws that apply to you.
- You must give accurate, complete registration information — including your real name, business name and a valid postal address that can appear in your emails — and keep it up to date.
- You are responsible for keeping your login credentials secure and for all activity under your account. We strongly recommend turning on two-factor authentication.
- You may add team members to your account where your plan allows. You are responsible for their use of the Service. Each login must belong to a single person.
- Tell us immediately at support@lebx.io if you suspect unauthorised access to your account.
We may refuse an account, or ask you to verify your identity, business or sending domain, before enabling some features (for example, higher sending limits).
The Service
Subject to these Terms and your plan, we grant you a limited, non-exclusive, non-transferable, revocable right to use the Service for your internal business purposes during your subscription.
We continuously improve the Service and may add, change or remove features. If we remove a feature that is material to a paid plan, we'll give you reasonable notice. Features labelled "beta", "preview" or similar are provided for evaluation, may change or be withdrawn, and are excluded from any commitments in these Terms.
Free plans and trials may have usage limits, may carry our branding in emails and may be changed or withdrawn at any time.
Some features (such as AI writing assistance) generate content automatically. You are responsible for reviewing generated content before you send or publish it.
Your content and contact data
You own your content. "Your Content" means everything you upload to or create in the Service — contact lists, subscriber data, emails, templates, images, forms, landing pages, funnels and ad creatives. As between you and us, you retain all rights in Your Content.
Licence to us. You grant Lebx a worldwide, non-exclusive, royalty-free licence to host, copy, process, transmit and display Your Content only as needed to provide, secure and support the Service, and as otherwise instructed by you. This licence ends when Your Content is deleted from the Service.
Personal data. For the contact and subscriber data you upload, you are the controller (or "data fiduciary") and we are your processor. Our Data Processing Addendum applies automatically and forms part of these Terms.
Your responsibilities. You confirm that you have all rights, consents and notices required by law to upload Your Content and to send communications to your contacts, and that Your Content does not infringe anyone's rights or break any law.
Backups. We back up the Service regularly, but you are responsible for keeping your own copies of important content. You can export your contacts and reports at any time.
Sending rules
Email only works when recipients trust it. When you use the Service you must:
- comply with our Acceptable Use & Anti-Spam Policy, which forms part of these Terms;
- send only to people who have given you verifiable permission to contact them;
- identify yourself accurately as the sender and include a valid physical postal address and a working unsubscribe link in every marketing email;
- comply with all applicable laws, including anti-spam, consumer protection, privacy and data protection laws such as the CAN-SPAM Act, GDPR and UK GDPR, PECR, CASL, India's Information Technology Act, 2000 and Digital Personal Data Protection Act, 2023.
To protect deliverability for all customers, we monitor sending activity. We may apply sending limits, delay or pause campaigns for review, require you to authenticate your sending domain, or require you to clean a list before sending.
Plans, billing and taxes
- Fees. Paid plans are billed in advance for each billing period (monthly, yearly or as shown at checkout), at the price shown when you subscribe.
- Automatic renewal. Subscriptions renew automatically at the end of each period until you turn off renewal or cancel. Turning off renewal lets your plan run to the end of the paid period; cancelling ends it immediately. Both are available any time from your account — see the Refund & Cancellation Policy.
- Taxes. Prices exclude taxes unless stated otherwise. You are responsible for applicable taxes, including GST, VAT and sales tax, which we will add where required by law.
- Usage and credits. Plans may include sending credits, contact limits or other quotas. Usage beyond your plan may require an upgrade or the purchase of additional credits.
- Price changes. We may change our prices. Any increase applies from your next renewal and we'll give you at least 30 days' notice by email.
- Late payment. If a payment fails, we may retry it and, if it remains unpaid, suspend sending or access to paid features until the balance is settled.
- Refunds. Refunds are handled under our Refund & Cancellation Policy. Please contact us before raising a chargeback so we can put things right.
Third-party services
The Service lets you connect third-party products — for example advertising platforms, e-commerce stores, payment providers and sign-in providers. Your use of those products is governed by their own terms and privacy policies. When you connect one, you authorise us to exchange data with it on your behalf. We are not responsible for third-party products, and we may stop supporting an integration if the third party changes or withdraws its service.
Our intellectual property
The Service — including its software, design, templates we provide, documentation, trademarks and logos — is owned by Lebx or its licensors and protected by intellectual property laws. Apart from the rights expressly granted in these Terms, no rights are transferred to you.
You must not: copy, modify or create derivative works of the Service; reverse engineer or attempt to extract its source code (except where the law allows); resell, sublicense or provide the Service to third parties as a standalone product without our written agreement; access the Service to build a competing product; or interfere with or disrupt its integrity, security or performance.
If you send us feedback or suggestions, we may use them without restriction or obligation to you.
Suspension and termination
By you. You may stop using the Service and cancel your subscription at any time from your account settings.
By us. We may suspend or terminate your account, or any part of the Service, if:
- you materially breach these Terms or the Acceptable Use Policy and (where the breach can be fixed) do not fix it within 7 days of notice;
- your sending causes, or is likely to cause, harm to recipients, to other customers, to our infrastructure or to our reputation with mailbox providers — in which case we may act immediately and without prior notice;
- fees remain unpaid after the due date; or
- we are required to do so by law, a court or a government authority.
Effect of termination. Your right to use the Service ends. For 30 days after termination (other than termination for serious abuse or legal reasons), you may ask us to help you export your data. After that we delete Your Content in line with our retention practices. Sections that by their nature should survive termination — including ownership, payment obligations, disclaimers, limitation of liability, indemnity and governing law — survive.
Availability and support
We work hard to keep the Service available and fast, but we do not guarantee uninterrupted or error-free operation. We may carry out planned maintenance, and will try to schedule it at low-traffic times and give notice where practical. Support is provided by email at support@lebx.io. Service levels, if any, apply only when agreed in a separate written agreement.
Email delivery depends on systems outside our control, including recipients' mail servers and spam filters. We cannot guarantee that any email will be delivered, placed in the inbox or opened.
Disclaimers
To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the Service will meet your requirements or achieve any particular business result. Nothing in these Terms excludes any warranty or right that cannot be excluded under applicable law, including your statutory rights as a consumer where they apply.
Limitation of liability
To the maximum extent permitted by law:
- neither party is liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profits, revenue, goodwill, data or business opportunity, however caused, even if advised of their possibility; and
- Lebx's total aggregate liability arising out of or relating to these Terms or the Service is limited to the fees you paid us for the Service in the three (3) months before the event giving rise to the claim (or INR 5,000 if you are on a free plan).
These limits do not apply to your payment obligations, your indemnity obligations, or liability that cannot be limited by law (such as liability for fraud, or for death or personal injury caused by negligence).
Indemnity
You will defend, indemnify and hold harmless Lebx, its affiliates and their personnel from any claims, losses, damages, fines, penalties and reasonable costs (including legal fees) arising from Your Content, the emails and other communications you send using the Service, your breach of these Terms or the Acceptable Use Policy, or your violation of any law or third-party right.
Changes to these Terms
We may update these Terms from time to time. If a change is material, we will notify account owners by email or in the app at least 14 days before it takes effect, unless the change is required sooner by law or relates to a new feature. The "Last updated" date at the top of this page shows when the Terms were last revised. If you continue to use the Service after changes take effect, you accept the updated Terms; if you do not agree, you may cancel before they take effect.
Governing law and disputes
These Terms are governed by the laws of India, without regard to conflict-of-law rules. Before starting any formal proceedings, both parties will try in good faith to resolve a dispute informally for at least 30 days after written notice. Subject to that, the courts at India have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service. Nothing in this section prevents either party from seeking urgent injunctive relief, or deprives a consumer of the protection of mandatory laws of their country of residence.
General
- Entire agreement. These Terms (with the documents they reference) are the entire agreement between you and us about the Service and replace any prior agreements on that subject.
- Assignment. You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition or sale of assets, or to an affiliate.
- Force majeure. Neither party is liable for delays or failures caused by events beyond its reasonable control, such as natural disasters, war, labour disputes, internet or power failures, or actions of governments or third-party providers (other than payment obligations).
- Severability and waiver. If any provision is found unenforceable, the rest remain in effect. A failure to enforce a provision is not a waiver of it.
- Notices. We send notices to the email address on your account. You can send notices to us at support@lebx.io.
- Independent parties. Nothing in these Terms creates a partnership, agency or employment relationship.
